The site’s footer has a generic disclaimer “Not medical advice. OTC hearing aids are not a substitute for professional care”, which is good practice, but mandatory warnings (age and red flags) must be added explicitly. FDA also expects the principal display to label the product as “OTC Hearing Aid”, which the site does use.

By purchasing, accessing, browsing, interacting with, relying upon, ordering from, communicating with, subscribing to, or otherwise using any products, services, websites, advertisements, text messages, emails, social media pages, content, educational materials, support channels, promotions, discounts, images, videos, product descriptions, or offerings made available by NEXA OTC Hearing Aids (“NEXA,” “Company,” “we,” “our,” or “us”), the customer, purchaser, visitor, user, recipient, or any third party acting on behalf of a purchaser expressly acknowledges and agrees that all products and services are provided on an “AS IS,” “AS AVAILABLE,” and “WITH ALL FAULTS” basis to the maximum extent permitted by applicable law. NEXA makes no representations, guarantees, promises, warranties, or assurances of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, uninterrupted functionality, compatibility, performance expectations, satisfaction, hearing outcomes, speech understanding, comfort, reliability, durability, suitability, or expected results. Hearing outcomes vary substantially among individuals and are affected by numerous factors beyond the control of NEXA, including but not limited to hearing severity, adaptation periods, anatomy, environmental noise, customer expectations, cognitive processing, speech discrimination ability, product fit, product maintenance, insertion techniques, battery conditions, charging practices, and customer compliance with instructions. Customer understands and acknowledges that hearing devices may perform differently in varying environments including restaurants, crowds, churches, family gatherings, television viewing, telephone conversations, automobiles, public spaces, outdoor environments, and noisy locations and that no representation is made that products will improve hearing in all settings or situations. Product photographs, videos, graphics, demonstrations, simulations, educational content, testimonials, before-and-after representations, comparisons, examples, descriptions, reviews, statements, star ratings, illustrations, and promotional materials are for informational and marketing purposes only and do not guarantee identical performance, appearance, or results.
Customer further understands and agrees that products sold by NEXA may be manufactured, assembled, sourced, distributed, imported, private-labeled, repackaged, relabeled, modified, customized, fulfilled, warehoused, or supplied by independent third-party manufacturers, OEM suppliers, distributors, logistics providers, or fulfillment partners and that product specifications, accessories, packaging, appearance, inserts, charging components, carrying cases, instructions, color, dimensions, labeling, software, and included materials may vary without notice. NEXA does not independently manufacture all products sold and does not warrant uninterrupted supply, exact consistency between production runs, or that future products will match prior inventory. Customer expressly acknowledges that electronic products and hearing devices may contain defects, limitations, software inconsistencies, battery degradation, charging irregularities, environmental sensitivity, component failure, cosmetic variations, fit variability, or operational limitations.
To the maximum extent permitted by law, NEXA and its owners, members, officers, managers, affiliates, subsidiaries, licensors, suppliers, contractors, employees, agents, successors, representatives, advertising partners, manufacturers, service providers, technology providers, fulfillment companies, shipping providers, and associated entities shall not be liable for any direct, indirect, incidental, consequential, punitive, exemplary, special, statutory, economic, emotional, medical, business, personal, reputational, or other damages of any nature whatsoever arising from or relating to product use, inability to use products, dissatisfaction, misuse, misunderstanding, product expectations, customer assumptions, delayed shipments, lost shipments, stolen packages, carrier errors, porch theft, customer entry errors, battery issues, charging issues, discomfort, product fit concerns, adaptation issues, hearing outcomes, hearing dissatisfaction, communication difficulties, speech clarity limitations, website downtime, technology failures, interrupted access, transaction failures, pricing errors, software issues, data loss, user mistakes, third-party actions, or any alleged injury or damages whether foreseeable or unforeseeable.
Customer agrees that NEXA shall not be responsible for acts beyond its control including but not limited to acts of God, severe weather, natural disasters, supply chain interruptions, labor shortages, manufacturing delays, shipping disruptions, internet failures, cyber incidents, payment processor issues, utility outages, government actions, public emergencies, customs delays, transportation failures, fraud, theft, strikes, pandemics, force majeure events, carrier disruptions, inventory shortages, or any circumstances preventing performance. NEXA reserves the right to modify products, discontinue products, substitute inventory, update specifications, revise prices, cancel promotions, limit quantities, reject transactions, deny service, refuse orders, investigate suspicious activity, or cancel orders at any time.
Customer acknowledges that all information provided by NEXA through support channels, customer service communications, website materials, FAQs, advertisements, educational content, emails, text messages, social media content, product descriptions, and marketing materials is intended solely for general informational purposes and shall not be interpreted as medical advice, audiological care, physician guidance, diagnosis, treatment recommendations, emergency services, or individualized healthcare advice. Customer agrees to seek qualified medical or audiological evaluation where appropriate and understands that NEXA products are not intended to diagnose, treat, cure, or prevent disease unless expressly required and permitted by law.
By completing a purchase, customer assumes all risks associated with use of products and agrees to use products only as instructed and intended. Customer agrees not to modify, alter, repair, misuse, reverse engineer, improperly maintain, or use products outside intended parameters. Customer further agrees to indemnify, defend, and hold harmless NEXA and all associated parties from any and all claims, demands, liabilities, lawsuits, damages, losses, expenses, attorney fees, disputes, investigations, or causes of action arising out of customer conduct, misuse, modification, unlawful activity, resale activity, negligence, improper use, or violation of these terms.
Customer expressly agrees that under no circumstances shall NEXA’s aggregate total liability under any theory of law, including contract, tort, negligence, strict liability, warranty claims, consumer claims, statutory claims, or otherwise exceed the total amount actually paid by the customer for the specific product giving rise to the claim. Customer further waives participation in class actions, representative proceedings, or collective claims where permitted by law and agrees that disputes shall be resolved individually. If any portion of this agreement is determined unenforceable, invalid, or prohibited by law, remaining provisions shall survive and remain enforceable to the fullest extent permitted. By using this website or purchasing products, customer acknowledges that they have read, understood, accepted, and agreed to these terms voluntarily and without reliance upon any statement not expressly contained herein.
